A COST-EFFECTIVE APPROACH

Paul and his team provide valuable collections law services that are cost effective.  If it is too expensive to make it worthwhile to litigate, the claim will be declined.  If the claim is worthwhile and it is feasible, the Firm will collect the claim on a contingent (percentage) basis.  This allows a creditor to avoid the double whammy:  not getting paid by the debtor and having to shell out more money for legal bills on an uncollected claim.  When possible, the Firm prefers a win-win lose-lose scenario:  the claim is collected and the client and Firm are paid; the claim is not collected and the client and Firm are not paid. 

The Firm also represents businesses in regular commercial litigation matters which is most often compensated in exchange of hourly fees, win or lose.

Most business litigation matters involve contracts and/or contracts law principles. Paul writes contracts, negotiates terms of contracts, and litigates the enforcement of contracts when they are breached. 

Too often partnerships end in “divorce” and the courts have to become involved in order to get the partners permanently separated. Paul makes every effort to get partners to negotiate in good faith to avoid the time and expense of litigation.  The goal is not to win but to keep the business running profitably or to get it up and running again in short order. 

A substantial segment of our economy involves real estate.  Inevitably, disputes arise over real estate ownership, obligations to pay for real estate, attempts to place liens on or to enforce liens on real estate, and efforts to foreclose on real estate.  Many such properties are commercial properties, not homes, which involves business litigation.  The Firm is often involved in such matters because someone is claiming another person owes them money having to do with real estate:  for the purchase price; for construction on, re-modeling of and/or improvements to the property; for taxes paid on the property; etc….  Often, such matters involve real estate law as well as collections and contracts law.  This how the Firm is usually brought in to a real estate dispute:  to collect money have to do with the real estate at issue.

Receiverships

Paul serves as the court appointed receiver for various matters in various courts where judgments have been obtained but remain unpaid.  Most often, a receiver is needed to enforce collection of a judgment by taking control over a debtor’s company and its cash or by selling its real and personal property.
